How We Do It

At the Law Offices of Alan M. Cohen & Associates LLC, we never give up the debt collection process on your behalf. We don’t waste your time sending letters or making phone calls. We know that you already did that.

Instead, upon receiving a case, our debt collection process starts by looking for the debtor’s assets and drafting the complaint in the way most likely to collect the bad debt. After we immediately draft a complaint we promptly file it with the court seeking where appropriate, ex parte attachments of your debtor’s bank account, income stream, real property, personal property, using bank attachments, real estate attachments, personal property attachments, keeper attachments, garageman liens, mechanic’s liens, reach and apply injunctions, equitable injunctions and/or Rule 65 Injunctions.

Once we obtain a judgment, we then pursue your debtor using the appropriate attachment to try to get you paid. Unlike the prejudgment attachments, these attachments are pursuant to and in conjunction with Rule 69 of the Massachusetts Rules of Civil Procedure. Rule 69 also allows discovery into your debtor’s assets. We use our innovative methods to search for assets to seize and then try to seize those assets to get you paid.

We never give up, until we are convinced the debt is absolutely uncollectable. If it is a corporate debt that is uncollectable, we may use Rule 69 discovery to peel back the onion to see if we can find a basis to pierce the corporate veil and go after the individuals in charge of that business entity. When a debt seems uncollectable now, we may put the collections on hold for a bit giving the judgment debtor time to forget about us and acquire assets in his, her or its name.

We pursue the debtors into bankruptcy. If an individual debtor passes, we look into whether there is an estate from which you could collect.
